# Terms of service

> The agreement for using Kombrewcha, including the home brewing safety disclaimer, the limits on our liability, and how disputes are resolved.

**Last updated September 21, 2026.**

These terms are an agreement between you and Proteinly LLC ("Proteinly", "we", "us"), the
publisher of the Kombrewcha app and this website. By downloading, installing or using Kombrewcha,
or by using this website, you agree to these terms. If you do not agree, do not use the app.

**Please read section 12 carefully.** It requires most disputes to be resolved by individual
binding arbitration rather than in court, and it waives your right to a jury trial and to take
part in a class action. You can opt out of arbitration within 30 days, as section 12 explains.

## 1. Who can use Kombrewcha

You must be at least 18 years old, or the age of majority where you live if that is higher, to
use the app or agree to these terms.

You may not use the app if you are located in a country subject to a United States government
embargo, or one designated by the United States government as a terrorist-supporting country, or
if you appear on any United States government list of prohibited or restricted parties.

You are responsible for following the laws that apply to you, including any law about making,
keeping or serving fermented or alcoholic beverages where you live.

## 2. Your license to use the app

When you buy Kombrewcha, we grant you a limited, personal, non-exclusive, non-transferable,
revocable license to use the app on devices you own or control, as permitted by the rules of the
store you bought it from. If you bought it on the Apple App Store, the license covers
Apple-branded products you own or control, and Family Sharing where Apple allows it.

You may not copy, modify, sell, rent, lend, distribute or reverse engineer the app, or try to
extract its source code, except where the law gives you a right to do so that cannot be waived.

## 3. Purchases and refunds

Kombrewcha is a one-time purchase made through the Apple App Store or Google Play. Payment,
billing and refunds are handled by the store under its own terms, not by us. We have no
subscription and no in-app purchases.

## 4. Home brewing is at your own risk

**Kombrewcha is a tracking and learning tool. It is not a food safety authority, and nothing in
it is professional, medical, nutritional or food safety advice.**

Making kombucha at home involves live cultures, acidic liquids and sealed containers under
pressure. You should understand the following before you brew.

- **The app cannot inspect a jar.** It does not know what is in your container and cannot tell
whether a batch is safe to drink. Durations, reminders and ready dates are suggestions based on
typical conditions. They are not a guarantee that a batch is done, safe or free of
  contamination.
- **Contamination is possible.** Mold and other unwanted organisms can grow in a batch. A batch
that shows mold should be thrown away. If you are unsure whether a batch is safe, do not drink
  it.
- **Sealed bottles can burst.** Carbonation builds pressure. Bottles not rated for pressure, or
left sealed too long, can crack or explode and cause injury. Use bottles made for carbonated
drinks and handle them with care.
- **Fermented drinks can contain alcohol.** Home-brewed kombucha is often under 1% alcohol but can
be higher after a long ferment. Do not serve it to anyone who should not drink alcohol.
- **Some people should not drink kombucha.** Food safety authorities advise caution for people
who are pregnant or breastfeeding, people with weakened immune systems, and young children. If
that applies to you or someone you serve, talk to a doctor first.
- **Articles, suggestions and community recipes are general information.** They may not suit your
equipment, ingredients, kitchen or health. Recipes published by other users have not been
  checked by us.

**You choose what to brew, how to brew it and whether to drink it, and you do so at your own
risk.** You are solely responsible for the ingredients, equipment and methods you use, for
judging whether anything you make is safe, and for anything you give to other people. To the
fullest extent the law allows, Proteinly is not responsible for any illness, injury, property
damage or loss arising from anything you make, drink, share or do while using the app, or from
relying on any content in it.

## 5. The community feed

The app lets you publish recipes to a community feed under a brewer name you choose. Anything you
publish is public.

**You keep ownership of what you publish.** By publishing, you grant Proteinly a worldwide,
non-exclusive, royalty-free license to host, store, display, reproduce and distribute it within
the app and in materials promoting the app, for as long as it stays published. You confirm that
you have the right to publish it and that it does not break these terms or anyone else's rights.

**You may not publish anything that:**

- is unlawful, harassing, hateful, threatening, sexually explicit or defamatory;
- encourages dangerous brewing practices, or makes health or medical claims;
- infringes anyone's copyright, trademark or other rights;
- impersonates another person, or uses a brewer name meant to mislead;
- contains personal information about someone else, spam or advertising.

**We may remove any content and suspend any brewer name** at our discretion, including content
reported by other users, without notice. We do not review recipes before they are published and we
are not responsible for content that other users publish. If you see something that breaks these
rules, report it in the app or write to us at the address in section 16.

## 6. Acceptable use

You agree not to misuse the app or our services. That includes trying to access them other than
through the app, interfering with or overloading them, scraping them, getting around any
limitation we put in place, or using them to break the law.

## 7. Intellectual property

The app, this website and everything in them that is not user content, including the design,
text, articles, graphics and the Kombrewcha name and logo, belong to Proteinly or its licensors
and are protected by law. These terms do not give you any right to use them except as needed to
use the app.

## 8. Third-party services and terms

The app relies on services run by others, including the app store you bought it from. Your use of
those services is governed by their own terms, and you must follow any third-party terms that
apply when you use the app. We are not responsible for services we do not control.

## 9. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE APP, THIS WEBSITE AND ALL CONTENT IN THEM ARE PROVIDED
"AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING
ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, OR
THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE. WE DO NOT WARRANT THAT ANY SUGGESTION, DURATION,
REMINDER, ARTICLE OR RECIPE IS ACCURATE, COMPLETE OR SAFE FOR YOUR USE.

Some places do not allow certain warranties to be excluded, so some of this section may not apply
to you.

## 10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROTEINLY AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE
LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR
ANY PERSONAL INJURY, ILLNESS, PROPERTY DAMAGE, LOSS OF DATA OR LOSS OF PROFITS, ARISING FROM OR
RELATED TO YOUR USE OF THE APP, THIS WEBSITE, ANY CONTENT IN THEM, OR ANYTHING YOU MAKE, DRINK OR
SHARE, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE APP OR THESE TERMS IS LIMITED TO THE GREATER OF
THE AMOUNT YOU PAID FOR THE APP OR FIFTY US DOLLARS (US$50).

These limits apply to every legal theory, whether contract, tort, negligence, strict liability or
otherwise. They do not limit liability that cannot be limited by law, such as liability for fraud
or, where the law requires it, for death or personal injury caused by gross negligence.

## 11. Indemnity

You agree to defend, indemnify and hold harmless Proteinly and its owners, employees and agents
from any claim, loss, liability or expense, including reasonable legal fees, arising from content
you publish, anything you make or give to others using the app, or your breach of these terms or
of the law.

## 12. Dispute resolution and arbitration

**Talk to us first.** Before starting any formal dispute, you agree to send us a written notice
describing the problem and what you want, at the email in section 16, and to give us 60 days to
try to resolve it informally. We will do the same for you. The time limit for bringing a claim is
paused while this process runs.

**Binding individual arbitration.** If we cannot resolve it informally, you and Proteinly agree
that any dispute arising from or relating to the app, this website or these terms will be
resolved by binding arbitration on an individual basis, under the Federal Arbitration Act. The
arbitration will be administered by the American Arbitration Association under its Consumer
Arbitration Rules, before a single arbitrator. It may be held by video or phone, or in the county
where you live. The arbitrator decides all questions, including whether a dispute must be
arbitrated, except as stated below.

**Costs.** For any claim under US$10,000, we will pay the filing, administration and arbitrator
fees that are more than what you would have paid to file in court, unless the arbitrator finds
your claim was frivolous or brought for an improper purpose.

**Small claims.** Either of us may instead bring an individual claim in small claims court, if it
qualifies there and stays there.

**No class actions.** YOU AND PROTEINLY EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY,
AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE
PROCEEDING. YOU AND PROTEINLY EACH WAIVE THE RIGHT TO A JURY TRIAL.

**Many claims at once.** If 25 or more similar claims are brought against us by the same or
coordinated counsel, they will be administered in batches of up to 50 at a time, with one
arbitrator per batch, and the remaining claims will be held until each batch is decided. A claim
is not filed, and no fees are owed on it, until its batch begins. Each claimant must personally
sign their notice and confirm its facts.

**Opting out.** You may opt out of this arbitration agreement by emailing us at the address in
section 16 within 30 days of first using the app, with your name and a clear statement that you
opt out of arbitration. Opting out does not affect any other part of these terms.

**If part of this section fails.** If the class action waiver is found unenforceable for a
particular claim, that claim must go to court rather than arbitration, and is paused until any
individual arbitration is finished. If any other part of this section is found unenforceable, the
rest still applies.

## 13. Governing law and courts

These terms are governed by the laws of the State of Delaware, without regard to its conflict of
law rules, and by the Federal Arbitration Act. Any dispute that is not arbitrated will be heard
only in the state or federal courts located in Delaware, and you and we consent to their
jurisdiction.

## 14. If you bought Kombrewcha on the Apple App Store

These terms apply between you and Proteinly only, and not with Apple Inc. ("Apple").

- **Responsibility.** Proteinly, not Apple, is solely responsible for the app and its content.
- **Maintenance and support.** Proteinly is solely responsible for any maintenance and support of
the app. Apple has no obligation to provide any.
- **Warranty.** If the app fails to meet any warranty that applies to it, you may notify Apple and
Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other
warranty obligation for the app. Any other claim, loss or cost from a failure to meet a warranty
is Proteinly's responsibility, to the extent it is not disclaimed in these terms.
- **Product claims.** Proteinly, not Apple, is responsible for any claim you or a third party make
about the app, including product liability claims, claims that the app fails to meet a legal or
regulatory requirement, and consumer protection claims.
- **Intellectual property.** If anyone claims the app infringes their intellectual property,
Proteinly, not Apple, is solely responsible for investigating, defending, settling and
  discharging that claim.
- **Third-party beneficiary.** Apple and its subsidiaries are third-party beneficiaries of these
terms and may enforce them against you.

## 15. Changes, termination and everything else

**Changes.** We may update these terms. If a change is material we will note it here and update
the date at the top. Continuing to use the app after a change means you accept it. A change to
section 12 will not apply to a dispute we already know about.

**Termination.** You may stop using the app at any time by deleting it. We may suspend or end your
access to the community feed if you break these terms. Sections 4, 5, 7, and 9 through 15
continue to apply after you stop using the app.

**Everything else.** These terms, with the [privacy policy](/privacy), are the whole agreement
between us about the app. If any part is found unenforceable, the rest stays in effect. Our not
enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them as
part of a sale or reorganization of our business. We are not responsible for delays caused by
events outside our reasonable control.
